Some of the information in this article is outdated. Florida and Virginia remain the only two states that use an FR-44 filing, but the systems aren’t the same — Virginia introduced it first, around 2008, while Florida built a stricter version with higher liability limits (100/300/50 vs. Virginia’s 50/100/25) and far less tolerance for lapses or missed payments. If you’re navigating a Florida FR-44 today, always confirm current requirements, since Florida’s rules are the more demanding of the two.
When people talk about “FR-44 insurance,” they usually assume it’s a Florida-only thing. And for the most part, that’s true — except for one other state:
Virginia.
Virginia is the only other place in the entire country that uses the FR-44 form. That’s it. No other state does it. And even though the names match, the two systems couldn’t be more different.
If you live in Florida and need an FR-44, your requirements, timelines, and penalties follow Florida law only — and trust me, they’re stricter and more expensive than anything Virginia has on the books.

Florida vs. Virginia: Which State Came First, Why They Created It, and How the Two Systems Compare
A lot of people wonder whether Florida copied Virginia, whether Virginia copied us, or whether both states came up with the idea at the same time.
Here’s the truth:
Which state used the FR-44 first?
Virginia introduced the FR-44 first, around 2008, as a stricter version of their SR-22 for alcohol-related offenses.
Florida followed soon after, implementing its own FR-44 in 2008–2009 as part of sweeping DUI-related insurance reforms.
So yes — Virginia was technically first, but Florida took the concept and built an even tougher version with higher liability limits and more rigid rules.
The Major Differences (Florida vs. Virginia)
1. Required Liability Limits
This is where Florida blows Virginia out of the water.

Florida’s limits are not only higher — they’re dramatically higher. And that’s the biggest reason Florida FR-44 premiums hit so hard.
2. Policy Structure & Cancellation Rules
Florida FR-44 policies must be paid in full (or on strict payment plans) and are non-cancellable, thanks to the October 1, 2023 rule tightening.
Virginia does not require full payment, and their cancellation rules are far more flexible.
Florida drivers don’t get second chances — miss a payment and the entire compliance timeline resets. That’s why I always tell clients: timing your start date correctly matters.
3. Compliance Periods
Florida = Three full years of continuous coverage
Virginia = Typically three years as well, but with fewer restrictions on cancellation and reinstatement.
In Florida, the “continuous coverage” requirement is much more unforgiving.

Virginia may have done it first, but Florida perfected it — if “perfected” means “made more expensive, stricter, and harder to navigate.”
